The move-in day that saves you the argument two years later

Almost every damage dispute comes down to what the unit looked like on day one. An hour of documentation at move-in is the cheapest insurance in the business.

01Why this matters more in Ontario

In most of North America a landlord facing damage at the end of a tenancy reaches for the security deposit. In Ontario there is no security deposit to reach for. Damage deposits are not permitted, and the last month's rent deposit can only ever be applied to the last month's rent.

So the only thing standing between you and an unrecoverable repair bill is evidence. Specifically, evidence of what the unit looked like before the tenant moved in, which is only obtainable on one day.

02The hour that does the work

    Photograph everything, timestamped

    Every room, wide and then close on anything already marked. Floors, walls, appliances, bathroom fixtures, window coverings, the inside of the fridge and the oven. Twenty minutes on a phone.

    Walk it with the tenant

    Do it together and write down what you both see. Existing scuffs and worn spots noted at move-in are a kindness to the tenant and a protection for you, because they are the things that would otherwise be argued about.

    Get it acknowledged in writing

    A signed or emailed confirmation that the record is accurate. It does not need to be a formal document. It needs a date and an agreement.

    Record the physical items

    How many keys, how many fobs, mailbox key, parking spot number, storage locker, garage remote. Note meter readings for any utility the tenant is taking over.

    Confirm responsibilities in writing

    Which utilities are in whose name, who changes furnace filters, who does the lawn and the snow. Confusion here is a slow-burning source of friction that shows up as a maintenance complaint six months later.

  • Confirm the lease is fully signed and the first month and deposit are recorded
  • Hand over building access details, parking rules and garbage day
  • Give the tenant one clear way to report maintenance, and use it yourself
  • Set expectations on rent reminders and how you communicate
  • Diarise the first tenancy anniversary for deposit interest and the rent increase window

05Keep it attached to the unit, not to your phone

The failure mode is not taking the photos. It is taking them and having no idea where they are two years later, on a phone you no longer own.

Questions landlords actually ask

Can I take a damage deposit in Ontario?

No. Ontario permits a last month's rent deposit of up to one month and a refundable key deposit limited to replacement cost. There is no damage or security deposit, which is why move-in documentation carries so much weight.

Is a written condition report required?

It is not required by the Residential Tenancies Act, but it is the practical difference between a damage claim that succeeds and one that fails for lack of evidence.

What counts as normal wear and tear?

Deterioration that happens through ordinary use over time: faded paint, worn carpet in traffic areas, minor scuffs. You cannot claim for it. Holes, burns, breakage and neglect are a different category.
